Government Can’t Ban Smoking in Offices: ITC

Apprehensive of the government notification banning smoking in "public places", including offices and restaurants, from October 2, ITC and the Indian Hotels Association have moved the Delhi high court challenging its legality, arguing that it makes no distinction between private and public spaces.

On Wednesday, ITC fielded legal luminary Soli Sorabjee who argued that the rule which bans smoking at workplaces is unjustified as it will include private offices like a lawyer’s chamber and the studio of an artist. “Private offices cannot be called public places as these are not accessible to the general public,’’ he said.

He also contended that the government had no power to take such a decision as the very act under which the notification had been devised had been stayed by the Madras high court.
